Terms of Service (US)

These Terms of Service ("Terms") apply to orders placed on ostrich-designs.com by customers shipping to an address in the United States. By placing such an order, you agree to these Terms. Customers ordering from outside the United States are covered by the separate terms published for their own market.

Who we are

Ostrich Designs is a trading name of The A2Z Stores Limited, a company registered in England and Wales. The A2Z Stores Limited is the seller of record for your order: it is who you are contracting with, who is responsible for your order, and who you should contact with any question or complaint, at colin@ostrich-designs.com or via our contact page.

Orders and acceptance

Placing an order is an offer to buy. A contract is formed when we confirm your order, not before. We may decline or cancel an order — for example if an item is unavailable, we spot a pricing error, or we can't verify payment — and if that happens we'll let you know and refund any payment taken.

Pricing and sales tax

Prices on the US site are shown in US dollars. We take reasonable care to keep them correct, but mistakes happen; if we find a pricing error before your order is produced, we'll contact you to confirm the correct price or cancel the order with a full refund. Sales tax is calculated and added at checkout for the state, and locality where applicable, that you're shipping to, where we're required to collect it.

Personalisation

Many of our products are personalised: you type a name, initials, a date, a registration plate, or similar text, and we print exactly what you typed. Please check your personalisation carefully before ordering — spelling, punctuation and spacing are printed as entered, and once production starts it can't be changed. See our Refund and Returns Policy for what happens if a personalised item arrives damaged, faulty, or not as ordered.

Product variance

Each item is printed individually. Screen colours, print colours and finish can vary slightly between the image you see online and the item you receive; this is normal for printed products and isn't a fault.

California Proposition 65

Some of our ceramic and enamel products are sold with a California Proposition 65 warning, shown on the relevant product pages, because they may expose you to chemicals including lead and/or cadmium at levels California requires a warning for. This warning reflects a California-specific legal requirement; it does not mean the product is unsafe for its intended, ordinary use. More information: www.P65Warnings.ca.gov.

Fulfilment

US orders are made to order, and printed and shipped within the United States by our print partners. See our Shipping Policy for delivery details.

Intellectual property

The designs, artwork and text on this site belong to us or our licensors. Buying a product gives you the physical item; it doesn't give you any right to copy, reproduce, redistribute or resell the artwork itself.

Warranties

We don't provide a separate written warranty on our products beyond the commitment in our Refund and Returns Policy to replace or refund an item that arrives damaged, faulty, or not as ordered. Nothing in these Terms disclaims, limits or is intended to disclaim or limit any warranty implied by the law of your state that cannot lawfully be disclaimed or limited — where such a warranty applies, it continues to apply in full, to the extent permitted by law.

Limitation of liability

To the extent permitted by law, our liability to you for a claim relating to an order is limited to the amount you paid for the item giving rise to the claim, and we are not liable for indirect, incidental, special or consequential damages. This limitation does not apply to, and nothing in these Terms limits, any liability that cannot lawfully be limited under the law of your state — including, where applicable, liability for gross negligence, wilful misconduct, fraud, or death or personal injury caused by a defective product.

If something goes wrong

If a dispute comes up, please contact us first at colin@ostrich-designs.com or via our contact page — most issues are resolved this way without needing anything more formal. Nothing in these Terms requires you to use arbitration or any other out-of-court process instead of going to court, and nothing in these Terms asks you to give up the right to bring or join a class, collective, or representative action. You always keep whatever rights your state's law gives a consumer in this situation, including the right to use your state's small-claims court.

Governing law

These Terms are governed by the laws of England and Wales. This does not remove any protection you're entitled to under the mandatory consumer-protection law of the state where you live, which continues to apply regardless of this choice, and nothing in these Terms is intended to stop you bringing a claim in your home state's courts where your state's law gives you that right as a consumer.

Changes to these Terms

We may update these Terms from time to time. We'll post the revised Terms on this page and update the "Last updated" date.
